Members of AFSCME Locals 575 won a major victory when the Governor signed SB 77, which provides the retroactive pay to LA Superior Court employees. Willie Pelote, AFSCME’s California Political Director credited the victory on the growing clout of AFSCME due to increased member participation in the PEOPLE program..“Victories like this would not have happened without member participation in the voluntary payroll deduction to our political fund.” Pelote said. “Because of PEOPLE we were able to get Republicans and Democrats to support us plus the Governor’s signature.

The retroactive payment covers the period August 1, 2005 to October 1, 2005 when the Union succeeded in obtaining a reclassification. At the time, Court administrators felt that they did not have to provide the pay raise retroactively; your union disagreed and fought to get the money. Two previous attempts were vetoed, but this year it was different and the Governor signed on.

This win is proof that an investment into the PEOPLE program yields results. If you are not participating in PEOPLE contact your union rep and join today.

F.A.Q. about our new Contract:

1.What has changed ?

Only four (4) articles were changed. They are: Article 6-SALARIES, Article 14-REASSIGNMENTS & TRANSFERS, Article 15-VACATION and Article 18-BONUS. All other aspects of the previous M.O.U. remain the same.

2.Will the M.O.U be available on COURTNET?

Yes, eventually. The Court is responsible for printing and making it available on Courtnet. The Union has no control over when that occurs.

3.How did our salary change?

You have a 4% raise effective 7/1/07, a 3% raise effective 7/1/08 and a 3% raise effective 7/1/09.

4. I've heard we got additional vacation days, how many?

JA's not receiving the 51/2% bonus received 14 Special Paid Leave days per year of the contract for a total of 42 days SPL. These days are not vacation days but may be used in lieu of vacation. You Union, in fact recommends that use these SPL days first and defer your vacation days as SPL days will not be paid should you leave Court service, however if you have vacation days remaining, you will be paid for those.

5.How soon can these additional days be used?

They may be used as soon as they are received, which is January 1, 2008 (14 days), January 1, 2008 (14 days) and January 1, 2009 (14 days).

6.Can management deny my using the SPL days in lieu of approved vacation?

No.

7.Do I have to train if asked to do so by management?

Training is something that may be asked of any JA. Your refusal to do so may be considered insubordination.

8.If I receive the 51/2% bonus, can I give that up and receive the 14 SPL days?

Yes. but if you switch, that change is final, there is no changing back, In December, you will be asked to let management know your desire to continue to receive the 51/2% or 14days SPL. No JA will receive both.

9. I work in a high volume courtroom, will it continue to be a bonus courtroom?

The court and Union are reviewing the criteria for high volume courtrooms. There may be some changes and some that currently receive the bonus may be eliminated, while others that previously were not so designated may receive a Bonus status or possibly additional staffing to ease the load.

10.How soon will the review of criteria for High Volume Courts occur?

The review has already begun, however it will be done on an ongoing basis. There is no completion date currently set.

11.If I want to change the jurisdiction in which I am working, but remain in the same location, do I have to complete a transfer request form?

Yes. A transfer request form must be completed anytime you wish to change locations, even if it is within the same district. Transfer request forms will be availble to all and updated annually on June 30th. You may submit a transfer request form anytime during the year, but each June 30th that form must be refreshed.

12.Can I schedule all of my vacation time at once?

Yes. All the vacation time that you will accrue in the year may be placed in an approved slot. The Court has assured us that there will be enough slots for each JA to take all the vacation that they accrue in a given year. Any deferred time that you have will have to be placed on the waiting list. If there is a specific time that you wish to take vacation and that time has previously been taken by someone with more seniority, you may elect to place that request on the waiting list, but there should be time available in the approved slots. That election is yours to take. (a sure spot on the approved slots or a chance on the waiting list)
